1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website located at brothersservices.com and any related pages, forms, applications, and digital tools (collectively, the “Site”), which are operated by Brothers Services Company (“Brothers Services,” “Brothers,”, “BSC”, “we,” “us,” or “our”).

By accessing or using the Site, submitting a quote request, providing your contact information, or otherwise communicating with us through the Site, you agree to be bound by these Terms and by our Privacy Policy, available at https://www.brothersservices.com/privacy-policy/, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Site.

If you are using the Site on behalf of a company, homeowners association, property management group, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract to use the Site, request an estimate, or opt in to receive communications from us. By using the Site, you represent that you meet these requirements.

3. Services and Service Area

Brothers Services Company is a licensed home improvement contractor providing residential and commercial exterior and remodeling services, including roofing repair and replacement, siding, gutters, windows and doors, decks and porches, sunrooms, bathroom remodeling, and storm damage and insurance claim assistance.

We serve Central Maryland, the Baltimore metropolitan area, and surrounding communities from our headquarters in Hampstead, Maryland. Service availability varies by location and project type. Descriptions of services on the Site are general in nature and do not constitute an offer to perform any particular scope of work at any particular location or price.

Brothers Services Company is licensed by the Maryland Home Improvement Commission, MHIC License No. 23479.

4. Quotes, Estimates, and Contracts

Requesting a quote does not create a contract. Any pricing, estimate, proposal, timeline, or scope of work presented on the Site, discussed by phone or text, or provided informally is preliminary and non-binding.

  • Estimates are based on information available at the time and are subject to change following a physical inspection of the property.
  • Estimates may expire, and material and labor pricing is subject to change based on market conditions and supplier availability.
  • No work is authorized, and no binding obligation is created on either party, until both you and an authorized representative of Brothers Services Company have signed a written contract or work authorization specifying the scope, price, and terms of the project.
  • Conditions discovered after work begins (including concealed damage, code requirements, structural deficiencies, or deck or sheathing replacement) may require a written change order and additional cost.
  • The written contract governs. In the event of any conflict between these Terms and a signed project contract or work authorization, the signed contract controls with respect to that project.

5. Insurance Claim Assistance

Brothers Services Company assists property owners in documenting storm, hail, and wind damage and in communicating with their insurance carriers. Please understand the following:

  • We are not a public adjuster, insurance agent, insurance broker, attorney, or law firm. We do not negotiate or settle claims on your behalf, and nothing we provide is legal advice or insurance advice.
  • We cannot and do not guarantee that your insurance carrier will approve a claim, approve any particular scope of work, or pay any particular amount.
  • All decisions regarding your claim, including whether to file, remain solely yours. Your policy, your carrier, and applicable law govern your claim.
  • You remain responsible for paying your insurance deductible. Brothers Services Company does not waive, absorb, rebate, discount, or pay any portion of a property owner’s deductible, and does not inflate an estimate to offset one. Any statement to the contrary by any person is unauthorized and is not binding on us. Offering to waive or absorb a deductible is prohibited for home improvement contractors under Maryland law and may constitute insurance fraud.
  • We may provide documentation, photographs, measurements, and estimates to support your claim, but you are responsible for the accuracy of information you provide to your carrier.

6. Warranties

Workmanship warranties, when offered, are described in your signed project contract and are subject to the conditions, exclusions, and registration requirements stated in that document. Manufacturer warranties on materials are provided by the manufacturer, not by Brothers Services Company, and are subject to the manufacturer’s own terms.

No warranty is created by anything on this Site. Statements on the Site regarding quality, durability, or performance are general marketing descriptions and are not warranties.

7. Digital Design Tools and Visualizations

The Site may offer rendering, visualization, and product-selection tools. These tools are provided as a convenience for planning purposes only.

Renderings are approximations. Colors, textures, proportions, lighting, and product appearance shown on a screen will differ from the finished installed product due to screen calibration, photographic conditions, manufacturing variation, and site conditions. Do not rely solely on a rendering or on-screen color when making a final product or color selection. We recommend reviewing physical samples in natural light before committing. We are not responsible for dissatisfaction arising from differences between a visualization and the finished work.

8. Photographs, Project Galleries, and Testimonials

Photographs in our project galleries depict past work and are illustrative only. They do not represent a guarantee that your project will have the same appearance, materials, or result. Testimonials reflect the experiences of individual customers and are not a guarantee of any particular outcome.

If you provide a review, photograph, or testimonial, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display it in our marketing materials, unless you tell us in writing that you would prefer we not.

9. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, project images, video, page layout, and software — is the property of Brothers Services Company or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.

You may view, download, and print Site content for your own personal, non-commercial use in connection with evaluating or managing a project with us. You may not otherwise copy, reproduce, republish, distribute, modify, scrape, frame, or create derivative works from the Site, or use our name, logo, or trademarks, without our prior written permission.

10. Your Submissions and Acceptable Use

When you submit information through the Site, including quote request forms and photographs of your property, you represent that the information is accurate and that you have the right to provide it.

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or fraudulent information, or impersonate another person
  • Submit a phone number or email address that is not yours or that you are not authorized to use
  • Attempt to gain unauthorized access to the Site, our servers, or any connected system
  • Introduce viruses, malware, or other harmful code
  • Use automated means to scrape, harvest, or collect data from the Site
  • Interfere with or disrupt the operation of the Site or its security features

We may refuse service, remove content, or restrict access to the Site at our discretion.

11. Third-Party Links and Services

The Site may link to or integrate third-party websites and services, including manufacturers, financing providers, review platforms, mapping services, and design tool vendors. We do not control and are not responsible for the content, products, privacy practices, or terms of any third party. Links are provided for convenience and do not imply endorsement. Your dealings with third parties are solely between you and that third party.

12. Financing

If financing options are referenced on the Site, financing is provided by independent third-party lenders, not by Brothers Services Company. All credit decisions, rates, terms, and approvals are determined solely by the lender. We do not guarantee approval or any particular terms.

13. Disclaimer of Warranties

THE SITE AND ALL CONTENT, TOOLS, AND MATERIALS ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Brothers Services Company disclaims all warranties with respect to the Site, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses, or that information on the Site is accurate, complete, or current.

This Section 13 applies to the Site only. It does not limit or disclaim any workmanship warranty expressly provided in a signed project contract, and it does not disclaim any warranty that cannot be disclaimed under applicable law.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Brothers Services Company and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the Site — even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to your use of the Site will not exceed one hundred dollars ($100.00).

This limitation applies to Site use only. It does not limit our liability under a signed project contract, and nothing in these Terms limits liability for fraud, willful misconduct, bodily injury, or any other liability that cannot be limited under Maryland law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Brothers Services Company and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, your submission of inaccurate or unauthorized information, or your violation of any law or third-party right.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Carroll County, Maryland, and you consent to the personal jurisdiction of those courts.

Disputes arising from a signed project contract are governed by the dispute resolution provisions of that contract.

17. Changes to These Terms

We may update these Terms at any time. The “Last Updated” date at the top reflects the most recent revision. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of that provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brothers Services Company regarding your use of the Site.

By providing your phone number to Brothers Services Company — through a form on our website, on a paper or digital document, or verbally to one of our representatives — and opting in, you provide your express written consent to receive recurring automated calls and text messages from Brothers Services Company at the number provided, including messages delivered using an automatic telephone dialing system or prerecorded or artificial voice.
